The Jacobs and Diemer team, working with trial counsel, obtained a grant of summary disposition and dismissal of all counts in a wrongful death case that had been pending in Wayne County Circuit Court. The Trial Court agreed with Jacobs and Diemer’s brief that Michigan legal authorities do not allow a party to manufacture a fact dispute that contradicts a video recording of the events.

The video recording revealed there was nothing the driver of the waste collection truck, or the trucking company, could have done to avoid the unfortunate accident. The trial court’s ruling resulted in the dismissal of a case where the defendant, a large national waste collection company, was facing more than $150 million in requested damages.
