By design, the laws, rules, and procedures that govern litigation are logical, predictable, and consistent. The same cannot always be said about juries and judges. When they get it wrong, parties call upon Tim Diemer to make things right. One of the nation’s premier appellate advocates, Tim has amassed an impressive and lengthy record of successful results, reversing scores of money judgments, parrying countless challenges on appeal, and working seamlessly with trial counsel to position their cases for positive outcomes at the appellate level.

The effectiveness of Tim’s advocacy is a product of more than his vast and diverse experience or his deeply ingrained understanding of the written and unwritten rules of appellate practice. What distinguishes Tim is his absolute and demonstrable commitment to his clients, their cases, and their causes. Injustice is anathema to Tim, especially when errors of fact or law stand to devastate his clients, their businesses, or their livelihoods. Armed with the insights and wisdom bestowed upon him by legendary appellate lawyer and firm founder John P. Jacobs, as well as his experience serving as a research attorney at the Michigan Court of Appeals, Tim has protected and advanced the interests of a broad range of clients in state and federal appellate courts across the country, including before the Supreme Court of the United States. His efforts have reversed or affirmed judgments on behalf of corporations, insurance carriers, small businesses, hospitals and doctors, municipalities, and other civil litigants.

While Tim is particularly adept at reversing potentially ruinous money judgments, he deploys his powerful advocacy, unwavering professionalism, and penchant for perfectionism in all aspects of appellate practice. Tim preserves hard-fought trial court victories against challenges on appeal, compels interlocutory reversals of adverse evidentiary rulings, or wrestles cases away from the trial court when controlling questions of law present an opportunity for early appellate review, sparing his clients from investing substantial resources into a trial that may not be necessary.

At the trial court level, Tim serves as a valuable adjunct for defense teams, working as embedded trial counsel to exclude damaging evidence, drafting dispositive motions and jury instructions to preserve critical legal issues in bet-the-company cases or other high-stakes litigation. While Tim understands the importance of his role, he also appreciates that he is there to assist and advise trial counsel, not usurp or needlessly interfere.
